1. Welcome to UsedorLess By using Our platform, You (as a Seller or a Buyer) agree to comply with and be bound by these Terms and Conditions. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Please read these terms carefully before using the platform. By accessing or using the Service You agree to be bound by these Terms and Conditions; If you do not agree with any part of these terms, you must refrain from using Our services.

2. Account Registration To use the services of UsedorLess, you (as a Seller or a Buyer) must create an account. You must provide accurate and complete information during registration and keep your account details up to date at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password;

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

3. Selling Your Device When you (as a Seller) list a device on UsedorLess, you will be required to provide accurate details about the device, including its model, condition, and any other necessary information and You will be considered as having signed the attached Online Sales Agreement. Once the device is sold, UsedorLess will facilitate the pickup and payment process.

4. Payment Policy for Sellers Transaction Process: When your device is purchased, the payment will be securely held by UsedorLess. The funds will only be released to you after the device has been inspected by Our technicians to ensure it meets the conditions you have described. If You (as a Buyer) expresses Your interest in a device, You will be considered as having signed the attached Transaction Service Agreement, the seller must reconfirm the availability and condition of the device. The device will be temporarily held for the Buyer until the purchase is completed. If payment is not made, UsedorLess does not guarantee the availability of the device.

Fees:

You (as a Buyer) shall pay UsedorLess for the Services and Products the following Fees as per the User Payment Agreement

Standard Fee: The final fee will be calculated as a percentage of the total sale amount ( sale amount includes the item price and additional shipping cost). A fee of 12.9% will apply to the sale amount up to $750.

Additional Fee: For sale amounts exceeding $750, an additional fee of 2.35% will be applied to the portion above $750.

Fixed Transaction Fee: A fixed transaction fee of $0.30 will also be deducted from the total.

Example: If your item is listed for $800, the total sale amount (including $10 shipping cost) will be $810. A 12.9% fee will be applied to the first $750 ($96.75), and 2.35% will be applied to the remaining $60 ($1.41). The total fee will be $98.46, and you will receive $701.54 after the fee and the fixed $0.30 transaction charge.

Payment Transfer: The payment will be transferred to your specified account after the device has been inspected and verified.

5. Device Inspection and Condition All devices are inspected upon pickup by UsedorLess. If the actual condition of the device differs from the description provided in the listing, we will notify you and return the device for re-evaluation. A new offer will be provided based on the updated condition. If the discrepancy is significant, we reserve the right to cancel the transaction and return the device to you.

6. Shipping and Pickup Pickup and Delivery: We offer pickup and delivery services for the devices. If the You as seller miss the pickup , additional charges may apply, if You as Buyer miss two delivery attempts, You will be required to pick up the device from Our location.

Rescheduling: You (as seller) may reschedule the pickup in case of unforeseen circumstances, but repeated missed pickups may lead to additional charges or account suspension.

7. Data Security All devices will be securely wiped of data before processing. We strongly encourage you to perform a factory reset and remove all personal data before submitting your device. UsedorLess will comply with all necessary data security standards to ensure your information remains protected.

You as Seller are responsible for erasing all personal data from their devices before listing. UsedorLess is not liable for any personal data remaining on a device once it has been picked up from You as Seller or delivered to the Buyer. While we make every effort to check device functions and specifications to ensure they match what has been disclosed in the listing, discrepancies found may lead to the cancellation of the transaction, a refund to You as the Buyer, and the return of the device to the Seller.

8. Warranty and Returns Devices under warranty may be accepted, but physical damage or defects typically void the warranty. Returns are not accepted once a device has been sold and the transaction is complete.

9. Cancellations and Lost Devices If a device is lost after it has been listed or sold, you must notify UsedorLess immediately. If the device is lost before the pickup, the listing will be removed, and the transaction will be canceled. If it is lost after confirming the pickup, the transaction will be canceled, and a fee may apply.

10. Fraud Prevention We use advanced AI-powered tools to verify the history of each device to ensure it is not stolen or blacklisted and whether its relevant taxes and duties are effectively paid, specially in the Countries where Mobiles Identification Registration System or similar solutions are implemented. Any device found to be stolen or blacklisted will not be accepted to be listed and You as Seller You will remain liable for any taxes and duties and relevant penalties not paid for any Device listed and not being taxes and duties /penalties cleared despite being taxable .

11. Account Suspension and Bans If repeated discrepancies occur with Your device listings as a Seller or if you fail to adhere to Our terms (such as missed pickups or delivering an incorrect device), your account may be suspended or banned from using UsedorLess.
